The National Academies’ policy history put the prehistory plainly: until the 1970s, cryptography policy and information about cryptography in the United States were largely the province of NSA.
That matters enormously.
Because it means the public-key revolution was not entering a neutral field. It was entering a field with a long-standing institutional owner.
There was some commercial cryptography. There were corporate devices, banking needs, and specialized civilian uses. But the most advanced ideas, the deepest experience, and the strongest policy influence lived inside the national-security system.
That arrangement did not have to be written as a monopoly in statute to function like one in practice.
The open public-key breakthrough changed the terms of the argument
In 1976, Whitfield Diffie and Martin Hellman published “New Directions in Cryptography.”
That paper opened with one of the most famous lines in the history of the field: that the world stood on the brink of a revolution in cryptography.
That was not hype.
It was diagnosis.
The paper said new cryptographic systems were needed to reduce dependence on secure key-distribution channels and to supply the equivalent of written signatures in digital systems. Most importantly, it described a model in which encryption and decryption could be governed by distinct keys, with the public key placed in a public directory while the private key remained secret.
That mattered because it broke a centuries-old operating assumption.
Before this, strong cryptography usually meant a shared secret had to be exchanged securely in advance. Public-key cryptography offered a different model: you could publish one key openly and still keep the real secret safe.
Why key distribution was the real strategic shock
This is the heart of the whole era.
The deepest government concern was not just that civilians would have “better encryption.” It was that the logistics problem that had historically favored governments was starting to dissolve.
Shared-key systems are manageable at state scale because states can build courier networks, key-distribution bureaucracies, and secure handling systems. Public-key systems change that equation.
If strangers can establish secrecy through public directories and one-way functions, then strong cryptography becomes easier to distribute through open networks, commercial software, and academic publication. That is a radically different world.
This is one reason NSA’s own communications-security history treated public-key cryptography as one of the most important outgrowths of rising private-sector interest in cryptography.
RSA made the idea practical
Diffie and Hellman gave the public the conceptual break. RSA gave it a practical implementation.
The 1978 RSA paper explicitly described itself as implementing the public-key cryptosystem concept that Diffie and Hellman had introduced, and it emphasized two abilities that would shape the rest of the era:
- secure encryption with publicly revealed keys,
- and digital signatures.
That mattered because the government could still have hoped that public-key cryptography would remain mostly theoretical after 1976.
RSA made that harder.
Once a practical method existed, the argument changed from: “can this kind of system exist?” to “what happens if everyone can use it?”
That is the moment when the policy problem became much more acute.
The irony is that the British government had discovered the idea first
One of the most revealing parts of the story is that the core public-key idea was not wholly new to the intelligence world.
NSA’s own Hall of Honor history says that James Ellis, Clifford Cocks, and Malcolm Williamson at GCHQ discovered public-key cryptography in the early 1970s, with Ellis proposing the possibility as early as 1970, Cocks devising a factoring-based system in 1973, and Williamson refining related methods in 1974.
That matters because it changes the emotional shape of the story.
The government did not react to public-key cryptography as though it were unimaginable. Rather, the Western cryptologic establishment already knew that ideas like this were possible.
What changed was not the mathematics alone. What changed was the publicness.
A secret discovery inside GCHQ was one thing. An open academic revolution was another.
The panic was about loss of control, not lack of understanding
This is why the phrase government panic era works.
The state was not reacting like an ignorant outsider confronted with incomprehensible mathematics. It was reacting like an institution that understood exactly why the mathematics mattered.
Public-key cryptography threatened to move serious secrecy out of controlled channels and into the ordinary world of universities, standards committees, commercial products, and networked software.
That mattered to:
- COMSEC, because it weakened the old logic of centralized key management,
- SIGINT, because it promised a wider spread of strong encryption in civilian hands,

DES was not public-key cryptography, but it belonged to the same conflict
A lot of people tell the story too neatly.
They say the public-key era begins in 1976 and then jump straight to the Clipper Chip in 1993.
That misses an important bridge: DES.
DES was a symmetric algorithm, not a public-key system. But it sat inside the same emerging political struggle.
NBS solicited a civilian data-encryption standard in the 1970s. IBM’s work was reviewed with NSA involvement. The resulting standard became public, but questions about the 56-bit key length, NSA’s role, and the strength of the design immediately turned the standard into a controversy.
That mattered because DES showed the shape of the coming fight: the government was willing to support public civilian cryptography, but only in forms it believed it could live with.
Why DES still matters on a page about public-key encryption
DES matters here because it revealed the government’s basic posture before the full public-key explosion matured.
The posture was not: “no civilian cryptography, ever.”
It was closer to:
- government-reviewed cryptography,
- standardized cryptography,
- export-controlled cryptography,
- and cryptography whose practical strength remained bounded.
The NBS FAQ from 1977 was explicit that exports of equipment performing cryptographic functions were subject to State Department munition-style controls. Later NIST historical writing described the export system even more starkly: vendors wanting to sell abroad often faced a choice between weakened 40-bit products or government-backed alternatives like Clipper.
DES therefore belongs in the prehistory of the panic era. It was the first big sign that public cryptography would be allowed only under pressure and with conditions.
NSA’s own histories show the institution felt the ground shifting
One of the most valuable sources here is NSA’s own historical writing on communications security.
It explicitly described the rise of “public cryptography” as a major challenge. It said the central issue that kept festering was “Academic Freedom versus National Security.” It also said the Agency was wrestling with the fact that its old shield of secrecy was being punctured and that public cryptography portended radical changes in NSA’s relationship with the private sector.
That matters enormously.
Because it shows that the anxiety was not invented later by critics. It was visible from inside the institution.
The Agency knew that open cryptography meant:
- more debate,
- more controversy,
- more external expertise,
- and less ability to decide everything from within a classified world.
The academic front became a real battlefield
This is where the era becomes unmistakably political.
The National Academies’ history says that in the late 1970s, major academic advances in cryptography prompted NSA responses that reached directly into scientific communication.
That included:
- prepublication review clauses in some government-sponsored university work,
- restricted contact between cryptographers and foreign visitors,
- NSA review of material intended for open meetings,
- and an unofficial warning that a Stanford presentation related to public-key cryptography might violate export-control laws.
That matters because it shows the real terrain of the fight.
This was not only a fight over devices. It was a fight over who could say what in public.
The secrecy-order episode mattered because it showed the old reflexes
The same National Academies history also notes that NSA imposed a secrecy order on a patent application filed by a University of Wisconsin professor.
That matters because it revealed something deeper than one bureaucratic intervention.
It showed the government reaching for old national-security mechanisms to contain a field that was slipping into the civilian research world.
In other words, the state’s first instinct was often not: “let us compete in open science.” It was: “can we still manage this by secrecy, licensing, and restricted dissemination?”
That instinct is one of the defining features of the panic era.
Public-key cryptography was turning into public cryptographic culture
Another thing changed in these years.
Public-key encryption was not just a technical scheme anymore. It was becoming a culture: papers, conference presentations, startup ideas, patent battles, open debate, and standards politics.
That mattered because once a field acquires a public culture, it becomes harder to govern through quiet case-by-case intervention.
Government could still influence licensing. It could still pressure standards. It could still advise State and Commerce on export controls. But it could no longer assume that the most consequential cryptographic ideas would remain behind the fence.
That is why the conflict kept widening.
Export controls became the main containment mechanism
If the government could not fully suppress public cryptography domestically, it could still try to contain its global spread.
Export controls became the main tool.
The National Academies’ policy history says cryptographic products and technical data were covered by both Commerce and munitions-style regimes, with strong advisory influence from NSA. It also noted that, at the time, most software and hardware using stronger cryptography remained on the Munitions List unless jurisdiction was shifted.
That mattered because export control could reach not only products but also technical data and public dissemination contexts.
This is one reason academic presentations and publications became flashpoints. In a connected world, public discussion could itself be treated as a kind of export problem.
Export control was not just a legal device, but a strategic holding action
The export-control system did not truly solve the problem. It slowed it.
That matters because it helps explain why the battles kept recurring.
As networked computing, electronic commerce, and global software distribution grew, export controls became harder to reconcile with commercial reality. NIST’s own cryptography history later described how unpopular the system was with vendors, who faced the choice of building weak export versions or weakening products for everyone.
That is a classic sign of a holding action. The old control model still existed, but the world it was trying to control had changed.
The Clipper Chip was the peak panic response
If you want the single clearest symbol of the era, it is Clipper.
In 1993, the Clinton White House announced the Clipper Chip initiative as a voluntary encryption program designed to improve secure communications while preserving lawful government access.
That matters because it shows the government trying to solve the problem on its own terms.
The idea was not to abolish encryption. The idea was to make strong encryption acceptable if it included built-in recoverability.
That is the essence of the panic-era mindset: strong secrecy would be tolerated, but only if the state could keep a key role.
Why Clipper mattered so much even though it was not public-key encryption
This is another important distinction.
The Clipper Chip and the Escrowed Encryption Standard were not themselves public-key encryption systems in the ordinary sense. They used SKIPJACK, a symmetric algorithm, alongside a Law Enforcement Access Field (LEAF) and escrow arrangements.
That matters because it reveals what the government was really trying to do.
Public-key cryptography had opened a world in which secrecy could spread too freely. Clipper was an attempt to bend the world back toward managed access.
So even though Clipper was not public-key encryption, it belongs at the center of a page about the panic era. It was the state’s most famous attempt to reinsert itself into the new cryptographic order.
The escrow architecture tells the story clearly
FIPS 185 said the Escrowed Encryption Standard specified SKIPJACK and a LEAF creation method that would support a key-escrow system. The NIST standards briefing later summarized the same thing bluntly: the standard mandated escrow agents protecting key components, and the LEAF carried the information needed for lawful access.
That mattered because it made the policy visible in technical form.
The government’s preferred answer to uncontrolled strong encryption was not: “trust us.” It was: “build the access into the system.”
That design logic is why the Clipper debate became so fierce.
NSA itself later recognized Clipper as a public defeat
A later NSA history on public image is extremely revealing here.
It said that, dealing with public cryptography of increasing strength, NSA became a proponent of the Clipper Chip. It then described NSA as a participant — and an ultimate loser — in the national debate that followed.
That matters enormously.
Because it is one of the clearest internal acknowledgments that the government’s effort to restore leverage through escrow failed politically.
The failure was not only technical. It was civic.
The public had learned enough by then to see the argument clearly.
DSS showed a different strategy: selective acceptance
At almost the same moment, government was also moving in a different direction.
NIST’s Digital Signature Standard formalized a public-key method for signatures. Its abstract made clear that digital signatures would support authenticity, integrity, and nonrepudiation.
That mattered because it showed the government was not rejecting all public-key techniques equally.
It could live with some public-key functions more easily than others.
That is an important nuance.
The hardest issue was not the existence of public-key mathematics in the abstract. The hardest issue was uncontrolled confidentiality — the part that most directly threatened intelligence access and law-enforcement aspirations.
This is why the period is better understood as a struggle to shape public cryptography, not simply to erase it.
The panic era ended gradually, not all at once
There was no single surrender ceremony.
Instead, the old model weakened piece by piece.
By the mid-1990s, export rules were already being revised. The National Archives’ executive-order record shows Executive Order 13026 in 1996 on the administration of export controls for encryption products. By the late 1990s, the White House’s own national-security strategy language was describing encryption export policy as a balancing exercise among national security, public safety, privacy, electronic commerce, and U.S. industry leadership.
That matters because it shows the tone changing.
The earlier posture had been closer to containment. The later posture was more openly about management and compromise.
Why the old model could not survive
The reason is not mysterious.
Once strong public cryptography existed:
- in papers,
- in products,
- in protocols,
- in browsers,
- in academic departments,
- and in global software markets,
the state could no longer plausibly return the field to quiet monopoly conditions.
That is what made the panic era temporary.
The government could still influence standards. It could still regulate exports. It could still argue for access. But it could not make the public-key revolution go back into the vault.
